SCOTUS Cites Durie Tangri Amicus Brief

Jun 3, 2021

This week, the Supreme Court issued its decision in Van Buren v. United States, in which Durie Tangri filed an amicus brief on behalf of amici technology companies Mozilla, Atlassian, and Shopify raising concerns regarding their bug bounty programs.  We argued that a broad reading of the “exceeding authorized access” provision in the Computer Fraud and Abuse Act would attach criminal penalties to a wide net of commonplace computer activity and accordingly chill legitimate security research performed through bug bounty programs and safe harbors.  Citing our brief, the Court resolved the circuit split in our clients’ favor and accordingly has put the fast-growing field of security research on much firmer ground.
