Firm Scores Summary Judgment Victory in Patent Infringement Case

August 26, 2010

Durie Tangri partners Daralyn Durie and Ryan Kent have secured a decisive victory on behalf of West Interactive Corporation in a patent infringement case having to do with speech recognition technology.

A Los Angeles federal judge dismissed an infringement complaint against West Interactive, concluding that three of plaintiff Phoenix Solutions Inc.'s asserted patents were invalid and a fourth was not infringed. U.S. District Judge Marilyn Pfaelzer ruled that Phoenix Solutions' patents were anticipated because the technology already was developed and used by Massachusetts Institute of Technology scientists long before the plaintiff filed for a patent application.
