Federal Circuit Affirms Win

Acacia subsidiary Compression Technologies brought suit against seven major storage companies in the eastern district of Missouri.  A number of companies settled, but Quantum, EMC and NetApp fought back and got the case transferred to the Northern District of California.  At the initial case management conference we asked for permission to file a fully drafted, twelve-page summary judgment motion and demonstrated that the patent was indefinite using a deck of cards to perform the claimed method.  Following briefing and Clem’s oral argument on behalf of all the defendants, the judge granted the summary judgment motion.  Acacia appealed to the Federal Circuit.  Durie Tangri once again drafted the briefing and Clem argued on behalf of all the respondents.  The Federal Circuit quickly affirmed the decision without opinion under Rule 36.
