Federal Circuit Affirms N.D. Ill. Victory

The Federal Circuit affirmed Durie Tangri’s win on behalf of client Commonwealth Edison Co. in the Northern District of Illinois today.  The case, brought by Atlas IP, claimed that electricity utility company infringed a wireless communications patent.  Judge Shadur held that Atlas had failed to articulate a plausible theory of infringement and dismissed the case with prejudice; following the dismissal, Durie Tangri won attorneys’ fees and costs for ComEd.  The case was one of the first to consider pleading standards for direct infringement after the recent amendments to the Federal Rules.
