Durie Tangri Wins Defense Verdict for CSU

On April 30, following a 3 week jury trial, a jury in San Francisco Superior Court granted a complete defense verdict in a class action brought on behalf of 170,000 students at Cal State University challenging fee increases in Fall 2009.  Plaintiffs were seeking a refund of fees paid totaling $54 million plus interest.  The students contended that CSU had breached the implied covenant of good faith and fair dealing by double billing them for the same classes when fees were increased in July.  The court had previously permitted the class to proceed as a class action.  The jury found that CSU did not act unreasonably in increasing students’ fees, even after they had already been charged and paid fees for the Fall term, in light of massive budget cuts.
