Durie Tangri filed a complaint and motion for a temporary restraining order on behalf of Shutterfly Inc. seeking to prevent a former employee from destroying any of Shutterfly’s code. Judge Susan Illston granted the motion which prevents the former employee “from destroying any current or archived electronic logs, metadata, and directories that relate to Shutterfly, including any Shutterfly code, as well as any emails and electronic documents that relate to Shutterfly.” Shutterfly contends that Zheng copied its proprietary code and established websites in China and America, yinquoduo.com and foreverarts.com, which use the code. The complaint against Zheng includes copyright infringement, misappropriation of trade secrets, and breach of contract. Durie Tangri partner Josh Lerner is lead counsel on the case and argued the motion.
