Durie Tangri secured a win on behalf of MobiTV, Inc. in a multi-defendant patent infringement suit brought by EON Corporation IP Holdings in the District of Delaware. The asserted patent dates back to 1991 and describes an interactive television system allowing the home viewer to interact with television programming. EON claimed that the patent covered any mobile computer with a wireless connection, including handheld smartphones running MobiTV’s video streaming applications. On March 5, 2014, following several rounds of briefing and an evidentiary hearing, the district court granted defendants’ motion for summary judgment, finding that each and every claim of the asserted patent was indefinite and therefore invalid.
