Durie Tangri managed to win the same case not once but twice in the Federal Circuit today. Representing major airlines and Ticketmaster against a patent troll, Durie Tangri last spring successfully defended the invalidity verdict issued following a jury trial in the Eastern District of Texas. But prior to the first win, the plaintiff sought to reopen the verdict on the ground that the mediator who failed to settle the case was biased. The district court rejected that claim, and the plaintiff appealed. Again, Durie Tangri defended, and in today’s ruling, the Federal Circuit unanimously affirmed the decision not to reopen the case.
