In a 2-1 precedential decision, the appeals court threw out the award today. The panel found that the Eastern District of Texas judge improperly instructed the jury on key claim construction terms. Instead of sending the case back to district court, the panel’s decision reverses the verdict completely and rules that Silver Spring did not infringe. The original verdict was for $18 million, which Durie Tangri reduced to $13 million on JMOL before filing the appeal.
